Privacy Policy

This privacy policy (the ”Privacy Policy”) is an integral part of the Terms of Use for the eCyLabs Services found here, and provides eCyLabs’s policies and procedures for collecting, using, and disclosing your personal information. Users can access the eCyLabs service (the “Service”) through the website eCyLabs.website, through APIs, and through third parties. This Privacy Policy governs your access to the Service, regardless which part of the Service you are using.

In this Privacy Policy, “Device” shall mean any computer, terminal, mobile or other electronic devices, from which you can gain access to the Services and “Personal Information” shall mean any information relating to an identified or identifiable natural person. All forms of data, content, and information (including Personal Information) described below are collectively referred to as “Information”.


Collecting Information

We at eCyLabs collect and process Personal Information in different ways and for different purposes.


Information provided by the user when registering for the Service: When you register an account at eCyLabs.website, you will be asked to submit your personal information such as your name, domain and e-mail address. We will also collect billing related information.

Information collected while using the Service: When you use the Service, Information from your Device, its software, and your activity using the Services will automatically be stored. This Information may include the Internet Protocol (“IP”) address of your Device, browser type, the web page visited before you came to the eCyLabs website, information on your search for the eCyLabs website, identification numbers associated with your Devices, your mobile carrier, local preferences, date and time stamps associated with your transactions, system configuration information, metadata concerning your files and other interactions with the Service. We will also collect usage-based activity data (e.g frequency of usage, activated functionality) to create an aggregated analysis of our customers’ usage pattern in order to improve the Service.

Non-product related information: If you interact with us at events or from other marketing activities and you give us your contact details or as to be contacted in one way or another, we will process that Information for this purpose.

Information from other sources. We may obtain Information from third parties and sources other than the Service, such as our partners, advertisers, credit rating agencies, and Integrated Services. How eCyLabs uses Personal Information

The Personal Information that eCyLabs collects from you will be used for the following purposes.

Making the Service available to you

We process your Personal Information in order to provide the Service to you, including administering your use, providing reports, personalizing and improving your experience of the Service and to provide support, software updates, information or other notifications regarding the Service, providing advice on best practice usage and to administer billing and other aspects of our contractual agreement, including dispute resolution. The legal basis for this processing is that it is necessary in order for us to provide you with the Service, which you have requested. If you have registered an account on behalf of your employer, the legal basis for the processing is that it is necessary for our legitimate interest in conducting business with your employer.

Improving the Service

We also process your Personal Information to improve the Service by monitoring and analyzing your use. The legal basis for this processing is that it is necessary for our legitimate interest in developing the Service.

Customized advertising and direct marketing

We may also use your Personal Information to send customized advertising, event invitations and other commercial communications. The legal basis for this processing is that it is necessary for our legitimate interest in maintaining good customer relations. You may at any time unsubscribe from any of these activities.

Accounting or other legal requirements

In some situations, we need to store your Personal Information in order to meet legal requirements, i.e. for accounting purposes.

Report Data

Your use of the Service will generate reports containing Information regarding your website. All reports generated as part of the Service will be stored by eCyLabs for the purpose of making the reports available to you. The reports may be deleted by you at any time. A report could include Personal Information if the Service gets access to it during security testing. eCyLabs act as a data processor in these events, and thus not as a data controller.



Cookies

Like many others, eCyLabs uses “cookies” to collect Information and improve the Service. A cookie is a small data file that is transferred to your Device when you use the Service. For security reasons, eCyLabs does not use “persistent cookies” to save your registration ID and login password for future logins to the Service. eCyLabs may however use “session ID cookies” to enable certain features of the Service, to better understand how you interact with the Service and to monitor aggregate usage and web traffic routing on the Service. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, if you do not accept cookies you may not be able to use all aspects of the Service.

In addition to using cookies and related technologies as described above, we may also permit certain third party companies to help us tailor advertising that we think may be of interest to users and to collect and use other data about user activities on our website and/or Services (e.g. to allow them to tailor ads on third party services). These companies may deliver ads that might also place cookies and otherwise track user behaviour.



For how long do we process your Personal Information?

We are committed to protecting your data privacy. We implement a data archival/removal policy that allows you to request removal of your personal information at any time. If you have entered into an agreement with us, we will process your information during the term and for up to 3 months thereafter to ensure business continuity and legal needs. After this period, your information will be securely anonymized or deleted. We also archive data in accordance with regulations. If you are an employee or another representative of a company which has entered into an agreement with us regarding the Service, we will process your Personal Information during the term of the agreement between us and the company and for a period of 3 months thereafter. After such period, we will anonymize or delete your Personal Information.

After account deactivation or a deletion request, your Personal Information will be retained for up to 3 months as part of back-up procedures.

Notwithstanding the above, we may keep certain Personal Information for a longer period if necessary in order to comply with applicable law (including book-keeping requirements), or, in the event of a legal dispute, for the time necessary for the legal process. If so, we will not use your Personal Information for any other purposes.

Sharing of personal information

Sub-processors

To provide the eCyLabs service to you we use a number of Sub-processors for your Personal Information. This includes technology providers, financial service providers, administrative systems and various tool integrations. They will receive Personal Information based on the need for the performing of their task, a full list of Sub-processors. Our contracts limit their usage of the data that you have provided to us.

Change of ownership or investments

Personal Information, may be disclosed and otherwise transferred to an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets and only if the recipient commits to a Privacy Policy that has terms substantially consistent with this Privacy Policy.

Legal and compliance requirements

Based on requirements for compliance with applicable laws as with government authorities and law enforcement.

Non-private or Non-Personal Information

eCyLabs may disclose, and make public, aggregated, non-private or otherwise non-personal information, such as usage statistics of the Service.

Transfer of Personal Information

eCyLabs may use certain trusted third party companies and individuals to help us provide, analyze, and improve the Service (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Service’s features). These third parties may be situated in countries outside of registered entity (eCylabs) and will have access to your Personal Information only for the purpose of performing these tasks on eCyLabs’s behalf and under obligations equivalent to those in this Privacy Policy.

Your control of the information

Changing or deleting your Information

You may review, update, correct or delete the Personal Information provided in your registration or account profile by changing your “account settings”. In some cases, eCyLabs may retain copies of your Personal Information if required by law.

Access to information

You are entitled to obtain information about your Personal Information stored and handled by eCyLabs at no cost by contacting eCyLabs. The request must be in writing and addressed to eCyLabs, on the address in our contact page, and must be signed by you.

Object processing

You may decline to share certain Personal Information with us, in which case we may not be able to provide you some of the features and functionality of the Service. You are always able to opt out from commercial communication. Restriction of processing

If you have a shared eCyLabs account, your administrator may be able to access Information in and about your shared account. Also access Information that you have provided or that is made available to you when using the account and control how your shared account may be accessed or deleted.

eCyLabs site may include links to other websites whose privacy practices may differ from those of eCyLabs. If you submit Information to sites other than those of eCyLabs, please be advised that your Information will be solely governed by their privacy statements. eCyLabs encourages you to carefully read the privacy statement of any website you visit.



Security

eCyLabs policy toward minors

eCyLabs’s Services are not directed to persons under the age of 18. eCyLabs, therefore, does not knowingly collect Personal Information from persons under the age of 18. If eCyLabs becomes aware that a child under 18 has provided us with Personal Information, eCyLabs will take steps to delete such information.

Client data

Since eCyLabs do not collect or determine the use of such Personal Information contained in data entered into the Service by you as a client, or that is created automatically as part of you using the Service (“Client data”),eCyLabs should not be considered a data controller for such Client data, and does not have the associated responsibilities.

Changes to the eCyLabs Privacy Policy

eCyLabs may revise this Privacy Policy from time to time and the most current version will always be posted on the eCyLabs website. If a revision at eCyLabs sole discretion is material eCyLabs will notify you (for example via email to the email address associated with your account). Other changes may be posted to the eCyLabs blog or terms page, so please check those pages regularly. If you continue to use the Services after you have been notified that a revision has become effective, you agree to be bound by the revised Privacy Policy. If you do not agree to the new Privacy Policy, you should immediately stop using the Services.
